Preamble
The following provisions establish the general terms and conditions of sale for the products offered by the company L'expressionist on its website: https://lexpressionist.com
L'expressionist, with a capital of €10,000, whose registered office is at 89 route de la reine, 92100 Boulogne Billancourt, and registered with the Nanterre Trade and Companies Register under number 941419376.
Article 1 – Application
These general terms and conditions of sale govern the contractual relations between L'avant gardiste and any professional (B2B) making a purchase on the site https://lexpressionist.com, hereinafter referred to as the "professional buyer." By becoming a member and/or client, adherence to L'expressionist (B2B site) implies full and unreserved acceptance of the general terms and conditions of sale.
L'expressionist reserves the right to modify its general terms and conditions of sale at any time. In such cases, the applicable conditions will be those in force on the date of the order placed by the professional buyer.
Article 2 – Registration
Registration is mandatory to access all products for sale on the site, unless otherwise specified. Membership is only granted after validation by the L'expressionist sales department. Given its selective distribution strategy, L'avant gardiste reserves the right to accept or refuse a professional member and to review access rights at any time.
The new professional member will receive a confirmation email at the address previously filled in the form, validating their registration with L'avant gardiste. The professional member holds a professional account through which they can make purchases.
The professional member does not have to set a password during registration. Each time they wish to connect to their account, they must enter their email address, after which they will receive a unique access code allowing them to log in.
By registering with L'expressionist, the professional member agrees to receive relevant information about products and services by email.
Article 3 – Products
L'expressionist strives to provide a complete description of the products available through descriptions, features, and photographs. The features are established based on data provided by suppliers.
L'expressionist undertakes to provide accurate representations of products in context. Professional members are encouraged to report any erroneous information appearing on a product sheet.
The products offered for sale are available for an indefinite period, subject to available stock.
The products offered for sale are sold for an indefinite period by L'avant gardiste and subject to available stock.
Article 4 – Prices
The prices displayed on L'expressionist are in euros, exclusive of tax. Shipping costs are not included, unless otherwise specified. Special packaging and special requests are not included. The amount of shipping costs varies according to the destination (refer to the Delivery page).
L'expressionist reserves the right to change its prices at any time. Products will be invoiced based on the rates in effect on the date of the order.
Article 5 – Ordering Procedures
Orders can only be placed on lexpressionist.com
Any buyer declares and warrants having the legal capacity to order on L'expressionist.
The buyer certifies, on the date of the order, that they are at least 18 years old or possess legal authorization allowing them to make a purchase on L'expressionist.
The buyer also guarantees that they are fully authorized to use the bank card provided for the transaction and that it is not being used fraudulently, and further undertakes that it has sufficient funds to cover the purchases made.
Any purchase made on lexpressionist.com will be deemed to have been made by the account user. All data recorded by L'avant gardiste constitutes proof of the transactions made by the buyer on lexpressionist.com
The order is only validated when the buyer has performed a double-click, in accordance with the Law on Trust in the Digital Economy of June 21, 2004: a first time to place the order and a second time to confirm it. The confirmation will be equivalent to a signature and acceptance of the operations carried out.
L'expressionist then sends a confirmation of the registered order by email, subject to full payment, and then a second email is sent to the member when the products are shipped with the tracking number, depending on the carrier.
Upon validation of your order, the information is immediately transmitted to our logistics provider so that your order can be prepared and sent as quickly as possible. It is therefore no longer possible for us to modify its content and the information provided when placing your order (delivery address, size, color, etc.). Product prices are indicated on the site in euros, excluding VAT for France and other countries, excluding customs duties and other taxes. Customs duties and other taxes must be paid by the customer directly to the carrier.
Article 6 – Payment Methods
Payment is made by bank card or bank transfer. The confirmed order will be effective after approval from the banking payment centers.
L'expressionist reserves the right to refuse any order in the event of a dispute with the professional buyer.
Article 7 – Payment Security
L'avant gardiste uses the SSL (Secure Socket Layer) security system, which consists of effectively encrypting all banking information via software.
No third party has access to confidential payment information. As a result, the member's banking details, when wishing to make purchases by bank card, will be required for each new order. In any case, and following a payment on lexpressionist.com, L'expressionist does not store or collect the confidential banking data of its clients. The credit/debit card number is never stored.
Article 8 – Product Unavailability
Despite all precautions, a product ordered and purchased may be unavailable. In the event of unavailability, L'expressionist will inform the professional buyer as soon as possible.
In the event of permanent unavailability, in accordance with the provisions of Article L121.20.3 of the Consumer Code, L'avant gardiste undertakes to fully refund the product, by automatic transfer to the account with which the buyer paid for their order, as soon as possible, and at the latest within fifteen days from the date of payment for the order.
An email will be sent to the buyer to notify them that their card has been credited and that their purchase is now refunded.
Article 9 – Delivery Methods
Orders placed on L'expressionist are delivered in metropolitan France by several different carriers: Colissimo, GLS, Chronopost, TNT, and by pallet (Schenker or Géodis).
Deliveries are made to the delivery address indicated at the time of the order and are limited to the geographical areas mentioned above. Neither the carrier nor L'expressionist can be held responsible for non-delivery due to an erroneous or incomplete delivery address.
In all cases, delivery times in working days are indicated when finalizing the order, and L'expressionist informs the buyer by email of the shipment of their package with its tracking number.
For any order placed before 12:00 PM on a working day, shipment will take place the same day, except in cases of force majeure. The buyer's absence at the time of delivery cannot be considered a delay. In the event of force majeure recognized by French case law, delivery times may be extended.
The times indicated by the carriers are indicative and not contractual. In the event of a delivery delay, the customer must contact L'avant gardiste as a priority at the address pro@lexpressionist.com or via the contact form to open an investigation with the chosen carrier. Shipping costs may be refunded to the customer if the carrier's investigation confirms the delay. An investigation result can take up to 21 working days.
In the event of non-receipt of a package within the indicated times, and a shipment has indeed been sent, the buyer has 7 days to claim their package. An investigation is conducted by L'expressionist with the carrier and can take several days, up to 30 working days. During this period, no refund or reshipment can be made. Once this period has passed, L'avant gardiste will no longer be able to proceed with an investigation.
In the event of a package declared delivered by the carrier but not received by the buyer, L'expressionist cannot be held responsible and undertakes to compensate its clients in the form of a credit note or reshipment of the articles of the non-received order, following an investigation opened with the carrier. No refund will be made.
Upon receipt of the order, we strongly recommend that the buyer check the conformity of the delivered products or refuse the package if it appears damaged.
Article 10 – Warranty and Liability
The liability of L'expressionist cannot be engaged in the event of any damage resulting from misuse of a product.
No compensation can be claimed outside of those provided by the Consumer Code. If a problem arises, the buyer first contacts L'avant gardiste to obtain an amicable solution, at the email address: pro@lexpressionist.com or on the contact form.
Within the framework of the legal guarantee of conformity, if the item ordered by the buyer shows a lack of conformity existing at the time of delivery, L'expressionist, according to what is possible, undertakes to:
Either replace the member's product or service with an identical product or service depending on available stock, or refund the price of the product in the form of a credit note within 30 days of the buyer's request if replacing with an identical or equivalent product or service proves impossible.
Article 11 – Intellectual Property
L'avant gardiste and L'expressionist are protected and registered trademarks with the National Institute of Industrial Property, the domain name being also protected.
All elements of the site lexpressionist.com are and remain the intellectual and exclusive property of L'avant gardiste.
As such and in accordance with the provisions of the Intellectual Property Code, no one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever other than private, even partially, without the agreement of L'expressionist.
Any placement of a simple or hypertext link, using the "framing" or "deep linking" technique to the site lexpressionist.com, is strictly prohibited.
lexpressionist.com or any other part of this site is strictly prohibited from reproduction, copying, and exploitation, for any purpose whatsoever, without express and written authorization.
Any copying, use for commercial reasons, and any parasitism based on the same sales method as L'avant gardiste is strictly prohibited and may give rise to lawsuits and sanctions, in matters of violation of intellectual property rights.
Article 12 – Confidential Data
Registration number with the CNIL, National Commission on Informatics and Liberty: 1458672, declaration of 10/11/2010 and 1722553, declaration of 11/25/2013.
All information and data of members is strictly confidential. L'expressionist undertakes to use this information exclusively in the context of the operation of its site. As such, L'expressionist undertakes neither to market nor to rent all data concerning members to a third party. In accordance with the provisions of Article 34 of the "Informatique et Libertés" law of January 6, 1978, members have the right to access, modify, and suspend data concerning them. To do this, the member can exercise this right by writing online in the Contact section or by clicking on "unsubscribe from the newsletter" on the last newsletter received.
L'expressionist undertakes to immediately delete members wishing to be removed from its database.
